General Conditions of Sale of BaronCollections®
BaronCollections®, a single-member simplified joint-stock company with its registered office at 9 rue des Colonnes 75002 Paris in France, is registered in the Paris Trade and Companies Register under number Paris B 983 377 573. These conditions govern the sales of products and services offered on our website baroncollections.fr .
1. Application and enforceability of the T&Cs
These general terms and conditions of sale define the conditions applicable to sales concluded between persons making a purchase via the BaronCollections® website, hereinafter referred to as "the customer" and the BaronCollections® company. These conditions apply exclusively to non-commercial individuals. The purchase of any product offered on the site requires the reading and express acceptance of these general terms and conditions of sale, without this acceptance being conditioned by a handwritten signature on the part of the customer. In accordance with the regulatory provisions in force relating to the conclusion of online contracts, the contract will be concluded when the customer has validated his order by his "double-click", an act which will constitute an electronic signature having, between the parties, the value of a handwritten signature.
2. Product information
Each product sold on baroncollections.fr is presented on the site with a description detailing its main technical characteristics. The photographs illustrating, in support of the text, the products do not enter into the contractual field. If errors have been introduced, under no circumstances can BaronCollections® be held liable for this. All of the products offered to its customers by BaronCollections® are available in our warehouse.
3. Pricing
Prices are shown in euros, all taxes included (TTC), taking into account the VAT applicable on the day of the order. Any change in the applicable rate may be reflected in the prices of the products. BaronCollections® reserves the right to modify its prices at any time, while guaranteeing the customer the application of the price in effect at the time of the order.
4. Order and validation of the transaction
Before any order, the customer must create an account on the baroncollections.fr website. The account creation section is accessible directly from the menu bar. On each visit, the customer, if he wishes to order or consult his account (order status, profile), must identify himself using this information. BaronCollections® offers the customer to order and pay for his products in several stages, with final validation options before confirming the order. The customer will receive a summary of the order before definitively validating it, to correct any errors. BaronCollections® confirms the order by email; this information includes in particular all the elements of the order and the customer's right of withdrawal.
5. Pre-orders and Cancellations
Pre-orders allow customers to secure items before their official release. These orders are also subject to our general terms and conditions of sale. In the event of cancellation of the pre-order by the customer, BaronCollections® reserves the right to withhold 20% of the total order amount as compensation for administrative costs incurred and potential losses. This withholding is deemed necessary to cover the costs associated with inventory management and unfinished orders.
6. Delivery
Delivery is scheduled to the address indicated by the customer within the time specified on the site. However, it should be noted that delivery times may vary depending on market saturation, product availability, and the need to place additional orders with our suppliers, particularly in Japan. In the event that the product is not immediately available for shipment, BaronCollections® undertakes to inform customers of foreseeable delays by email and to provide an estimate of the adjusted delivery time. We make every effort to minimize these inconveniences and to ensure delivery as soon as possible.
7. Right of withdrawal
In accordance with the legislation in force for online sales, the customer has a right of withdrawal that he can exercise within fourteen working days following the date of delivery of his order, without having to justify his decision or bear any costs other than those related to the return of the products. The products must be returned in their original condition and complete (packaging, accessories, instructions, etc.) allowing their remarketing in new condition, accompanied by the purchase invoice.
8. Intellectual property
All elements of the BaronCollections® site, whether visual or audio, including the underlying technology, are protected by copyright, trademarks or patents. They are the exclusive property of the BaronCollections® company. The user who has a personal website and who wishes to place, for personal use, on his site a simple link directly to the homepage of the BaronCollections® site, must request authorization from the BaronCollections® company. Any hyperlink to the BaronCollections® site and using the framing or in-line linking technique is strictly prohibited. In all cases, any link, even tacitly authorized, must be removed upon simple request from the BaronCollections® company.
9. Legal information and respect for privacy
The provision of personal information collected in the context of distance selling is mandatory, this information being essential for the processing and delivery of orders, the preparation of invoices and the guarantees of contracts. Failure to provide information will result in the order not being validated. In accordance with the "Informatique et Libertés" law, the processing of personal information relating to customers has been declared to the National Commission for Information Technology and Civil Liberties (CNIL). The customer has (article 34 of the law of 6 January 1978) a right of access, modification, rectification and deletion of data concerning him, which he can exercise with BaronCollections®. In addition, BaronCollections® undertakes not to communicate, free of charge or for compensation, the contact details of its customers to a third party.
